These Terms of Service (the “Terms”) govern your use of midapparel.com (the “Site”) and your purchase of products from Mid Apparel (“we,” “us,” “our”). By accessing the Site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. Who we are
Mid Apparel is a direct-to-consumer apparel brand operated from Ft Mitchell, Kentucky, United States. Products are manufactured on demand by our print-on-demand partner Printify and its network of print providers, and shipped by Printify’s carrier partners. Mid Apparel is the seller of record and merchant of record for all transactions on this Site; Printify is our production and fulfillment partner.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to purchase from this Site.
3. Orders, prices, and payment
- All prices are in US dollars (USD) and exclude any applicable taxes and shipping unless explicitly stated.
- We reserve the right to refuse, cancel, or limit any order — including for suspected fraud, obvious pricing errors, or production constraints.
- If we cancel an order you’ve already paid for, we will refund the original payment method in full.
- Promotional pricing (bundles, free shipping thresholds, discount codes) is honored only on orders that meet the stated conditions at the time of checkout.
4. Products, descriptions, and design
- Photographs and mockups are representative. Slight variation in color, print placement (up to ~1/2 inch), and fit is normal for print-on-demand apparel.
- We reserve the right to discontinue any design, color, or size at any time.
5. Intellectual property and design rights — please read
The slogans, jokes, phrases, and graphic treatments printed on Mid Apparel products draw from common cultural expressions, everyday internet vernacular, and the public domain of ordinary language. Mid Apparel does not claim ownership of any underlying phrase, slogan, joke, or cultural reference printed on its products. Many of these phrases are widely used, have multiple originators, or exist in the public domain.
If you are the rightful owner of any phrase, image, slogan, design element, or other protected work appearing on a Mid Apparel product and you would like it removed, we will remove the listing promptly upon a good-faith request. Send written notice to thomasruedebuschbusiness16@gmail.com that includes:
- The exact product or design in question (a link or screenshot is ideal),
- The basis of your claim (e.g., registered trademark number, copyright registration, prior use),
- Your contact information,
- A good-faith statement that you believe the use is unauthorized, and
- Your physical or electronic signature.
We will respond within 5 business days and, where the claim appears credible, remove the listing while we investigate. Removal is not an admission of liability or wrongdoing. This section also serves as our DMCA designated-agent notice address for copyright takedown requests under 17 U.S.C. § 512(c).
6. User-submitted content
If you submit reviews, photos, suggestions, or other content to the Site, you grant Mid Apparel a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing and operational purposes. You represent that you own or have the right to share the content you submit.
7. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose,
- Scrape, copy, or republish Site content without written permission,
- Attempt to interfere with the security or operation of the Site,
- Resell Mid Apparel products without written authorization.
8. Disclaimer of warranties
The Site and the products are provided “as is” and “as available.” To the maximum extent permitted by law, Mid Apparel disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Where applicable law does not permit the exclusion of certain warranties, this disclaimer applies to the maximum extent permitted.
9. Limitation of liability
To the maximum extent permitted by law, Mid Apparel’s total aggregate liability arising from or related to your use of the Site or purchase of products is limited to the amount you paid for the specific order giving rise to the claim. In no event will Mid Apparel be liable for indirect, incidental, consequential, special, or punitive damages.
10. Indemnification
You agree to indemnify and hold harmless Mid Apparel, its operators, affiliates, and production partners from any claim or demand arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
11. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or your purchase will be brought exclusively in the state or federal courts located in Kenton County, Kentucky, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking relief in small-claims court where appropriate.
12. Changes to these Terms
We may update these Terms at any time. The “Last updated” date above will reflect the most recent revision. Continued use of the Site after a change constitutes acceptance of the updated Terms.
